I am a 40+ year resident of Fayette County and own businesses w/thousands of clients over the last 20 years. I spent the morning reaching to them via my email list/social media platforms. We chose this location to store inventory, family heirlooms, and other personal belongings b/c of the proximity. Since 2024, the rate went up over 50% and because of this, we intended to move out at the end of the month, 9/28. My husband went into the facility in late July and inquired about paying our balance plus a partial payment so that when we moved out at the end of September, we would not have a full final month’s rent due. I am currently undergoing extensive dental work and have pressing medical issue otherwise, so was not willing to pre-pay an entire month on top of the balance at that time. I planned on paying our full balance on September 28, the day that I would be paying all bills for the upcoming month. During that visit, the only information relayed to my husband was that they could not take a partial payment and it would need to be paid when we moved out. However, they actually had an auction set up for August 13. The onsite representative didn’t mention this to him. It was only on September 28 when my husband called to confirm what the balance was approximately 30 minutes before our helpers were to arrive to help us move our belongings out of the unit that he was told that there had supposedly been an auction of our items. When we both visited the location to get documentation, we were provided with a copy of a lease notice, but no verifiable proof that they had followed Georgia law with regard of a potential auction. We hand-delivered a demand letter to this location, sent a demand letter via certified mail (something that they need to learn how to do) and the same certified letter to corporate in Utah. Since last Friday, I have received no response from anyone at any level of this company. Do yourself a favor and also google this company with regard to other lawsuits and judgments and other states – – these locations are not franchised, so this is in no way a locally-owned business. I know what OCGA (and HIB 131) says very specifically and clearly about legal notification and I also know that this facility did not follow the legal requirements for notification. Not even getting into how incredibly disgusting it is that the representative onsite in July did not mention it to my husband (the VERY DAY he could have immediately paid any monies owed) but laws are in place for a reason. All over the country, this company has had lawsuits involving the abuse of tenants. I immediately knew that they had not followed whatever laws were on the books and I’ve been in constant contact with my attorney since last Friday. We gave Extra Space the opportunity to respond to those demand letters, with our initial offer of just accepting the return of our belongings, but now we’re going to file in State Court. Large companies like this rely upon tenants who have been mistreated to not have the funds, the ability, or the time to actually seek legal relief. I have all three, plus a significant amount of reach. To my neighbors in Trillith, Canoe Club, Stonebriar, my own neighborhood, and anywhere in the county, find another storage facility to store your belongings. In addition to the entire inventory for one of our businesses and 200 year-old family heirlooms, the only ultrasound photos that existed of my first deceased child were stored in that unit. Ironically, they were stored there because we are doing extensive remodeling in our home and I wanted them to be in a temperature-controlled, safe, and secure environment. We were not offered these personal items, but looking at the whole situation – – it does not surprise me that that very basic rule of decency was also not followed. I will come back once this has worked its way through the courts and update anyone looking for reviews with what the conclusion was.
